• Strategic review of Local Control and Accountability Plans (LCAPs) against California education priorities
• Gmail analytics and visualization of email traffic patterns
• AI-powered email response generation and management
• Integration with Google Drive, Gmail, and Google Docs APIs

3. Eligibility and Account Requirements

To use BoardPlus.ai, you must:

• Be at least 18 years of age or the age of majority in your jurisdiction
• Be an educational professional, administrator, or board member authorized to access educational documents
• Have a valid Google account for authentication
• Provide accurate and complete registration information
• Maintain the confidentiality of your account credentials

You are responsible for all activities that occur under your account.

4. Data and Privacy

Your use of BoardPlus.ai is also governed by our Privacy Policy. Key points include:

• Document and email content is processed for AI analysis but not stored permanently unless necessary for service delivery
• Your data is not used to train AI models or for advertising purposes
• Documents remain in your Google Drive; BoardPlus.ai accesses them only when you request analysis
• You retain ownership of all content you provide to BoardPlus.ai

5. Educational Use and Compliance

If you use BoardPlus.ai to process student information:

• You represent that you have the authority to access and process such information under FERPA and applicable laws
• You agree to use the Service only for legitimate educational purposes
• You are responsible for maintaining compliance with all applicable educational privacy laws
• Schools and districts using BoardPlus.ai operate as the "school official" under FERPA's exception

6. Acceptable Use

You agree NOT to:

• Use the Service for any unlawful purpose or in violation of these Terms
• Access data or documents you are not authorized to view
• Share your account credentials with unauthorized individuals
• Attempt to bypass security measures or access restrictions
• Use the Service to harass, abuse, or harm others
• Upload malicious code, viruses, or harmful content
• Reverse engineer, decompile, or attempt to extract source code from the Service
• Use automated systems (bots, scrapers) to access the Service without permission
• Interfere with or disrupt the Service or its servers

7. Intellectual Property

All content, features, and functionality of BoardPlus.ai (including but not limited to software, text, graphics, logos, and AI-generated analysis frameworks) are owned by BoardPlus.ai or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not:

• Reproduce, distribute, or create derivative works from the Service without written permission
• Remove or modify any copyright or proprietary notices
• Use BoardPlus.ai's name, logo, or trademarks without authorization

8. AI-Generated Content

BoardPlus.ai uses Google Gemini AI to generate document analyses and email responses. You acknowledge that:

• AI-generated content is provided as suggestions and may contain errors or inaccuracies
• You are responsible for reviewing and verifying all AI-generated content before relying on it
• BoardPlus.ai does not guarantee the accuracy, completeness, or reliability of AI-generated content
• AI analyses should be used as one input among many in your decision-making process
• You should not solely rely on AI-generated content for legal compliance or critical decisions

9. Third-Party Services

BoardPlus.ai integrates with Google services (Drive, Gmail, Docs, OAuth) and Google Gemini AI. Your use of these third-party services is subject to their respective terms of service and privacy policies. BoardPlus.ai is not responsible for the availability, performance, or policies of third-party services.

10. Service Availability and Modifications

BoardPlus.ai strives to maintain service availability but does not guarantee uninterrupted access. We reserve the right to:

• Modify, suspend, or discontinue any part of the Service at any time
• Impose usage limits or restrictions
• Update these Terms of Service (changes will be communicated via email or the platform)

Continued use after changes constitutes acceptance of the updated terms.

11. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

BoardPlus.ai disclaims all warranties, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties regarding accuracy, reliability, or completeness of content
• Warranties that the Service will be error-free or uninterrupted

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOARDPLUS.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR DAMAGES RESULTING FROM USE OR INABILITY TO USE THE SERVICE.

Our total liability for any claims arising from your use of BoardPlus.ai shall not exceed the amount you paid to BoardPlus.ai in the 12 months preceding the claim, or $100, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless BoardPlus.ai and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your unauthorized access to or use of student data or educational records

13. Termination

You may terminate your use of BoardPlus.ai at any time by:

• Revoking access permissions through your Google account settings
• Ceasing to use the Service

BoardPlus.ai may suspend or terminate your access at any time, with or without notice, if we believe you have violated these Terms or for any other reason.

Upon termination:

• Your right to use the Service ceases immediately
• We may delete your account data in accordance with our Privacy Policy
• Provisions regarding intellectual property, disclaimers, and limitations of liability survive termination

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these Terms or your use of BoardPlus.ai shall be resolved through binding arbitration in California, except that either party may seek injunctive relief in court for intellectual property matters.

15. Miscellaneous

• Entire Agreement: These Terms constitute the entire agreement between you and BoardPlus.ai
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect
• No Waiver: Failure to enforce any provision does not constitute a waiver
